In relation to our processing of Personal Data you have certain rights of information on and access to the Personal Data we process in connection with your relation with EU Organic Tea.

EU Organic Tea will take all appropriate measures to ensure that you are provided with the information that is to be provided in connection with EU Organic Tea's processing of Personal Data and that requests from you in relation to the processing of Personal Data are handled effectively and with due care.

EU Organic Tea’s duty of information

1. According to the GDPR, you have a right to be informed of Personal Data being collected by EU Organic Tea.

2. EU Organic Tea will, at the time of EU Organic Tea’s collection of Personal Data from you, provide you with the information pursuant to Article 13, paragraph 1, of the GDPR, and the information pursuant to Article 13, paragraph 2, in order to ensure a fair and transparent processing of the Personal Data.

3. If EU Organic Tea intends to further process Personal Data collected from you for another purpose than the purpose to which the Personal Data was originally collected, EU Organic Tea will provide you with information of the new purpose to which the Personal Data will be processed and other relevant information, including e.g. the relevant time period for processing of the Personal Data, access rights, deletion etc.

4. The above mentioned duty of information does not apply if you already have the information.

5. Additionally, EU Organic Tea will inform you of EU Organic Tea’s collection of Personal Data, which is collected from others and provide you with the information pursuant to Article 14, paragraph 1, of the GDPR, and the information pursuant to Article 14, paragraph 2, in order to ensure a fair and transparent processing of the Personal Data. Such information will be provided within a reasonable period after obtaining the Personal Data and in accordance with the time limits pursuant to Article 14, paragraph 3, of the GDPR.

6. If EU Organic Tea intends to further process Personal Data, which is not collected from you, for another purpose than the purpose to which the Personal Data was originally collected, EU Organic Tea will provide you in question with information of the new purpose to which the Personal Data will be processed and other relevant information, including e.g. the relevant time period for processing of the Personal Data, access rights, deletion etc.

7. The above mentioned duty of information does not apply in the circumstances described in Article 14, paragraph 5, of the GDPR, including if you already have the information.

Right of access

1. You have a right to receive confirmation as to whether or not Personal Data concerning you are being processed, and, where that is the case, access to the Personal Data (as a main rule, a copy of such data will be provided). You also have the right to receive the information pursuant to Article 15 of the GDPR (compare with the information described in the section above).

2. If EU Organic Tea transfers Personal Data to a third country or to an international organisation, you have the right to be informed of the appropriate safeguards we apply to such transfer.

3. The right of access does not apply if we assess that the interest in obtaining the information of you in question is overridden by essential considerations of private interests, including the consideration for you him/herself.

Right of rectification

1. You have the right to request rectification of incorrect or inaccurate Personal Data, including the right to have incomplete Personal Data completed, including by means of providing a supplementary statement etc. as further described in Article 16 of the GDPR.

2. Upon receipt of such a request, we will process the request without undue delay.

3. Please note that the right of rectification concerns “objective” Personal Data and not our specific (subjective) assessments. That you do not agree with an assessment that we have made does therefore not necessarily entail that you in question can require such an assessment rectified with reference to the right of rectification, unless the request concerns a fact based error, inaccuracy or similar objective discrepancy in our assessment.

Right to erasure (the “right to be forgotten”)

1. You have the right to require Personal Data deleted if certain grounds for such deletion are met as further described in Article 17 of the GDPR.

2. Upon receipt of such a request, we will process the request without undue delay.

3. However, the right to erasure does not apply to the extent that EU Organic Tea’s processing of the Personal Data in question is necessary for compliance with a legal obligation which requires processing of the Personal Data, including, but not limited to, obligations pursuant to applicable tax legislation, employment legislation and, if relevant, collective bargaining agreements etc.

4. Further, the right to erasure does not apply to the extent that EU Organic Tea’s processing of the Personal Data is necessary for EU Organic Tea’s establishment, exercise or defence of legal claims.

Right to restriction of processing

1. You have the right to obtain restriction of processing of the Personal Data concerning you in question where one of the following applies:

   • the accuracy of the Personal Data is contested by you, but only for the period required for EU Organic Tea to verify the accuracy of the Personal Data in question

   • the processing of the Personal Data is unlawful and you opposes the erasure of the Personal Data and requests restriction of the use of the Personal Data instead

   • EU Organic Tea no longer needs the Personal Data for the purposes of processing, but the Personal Data is required by you for the establishment, exercise or defence of legal claims

   • you have objected to the processing pursuant to Article 21, paragraph 1, of the GDPR, pending EU Organic Tea’s verification of whether the legitimate grounds of EU Organic Tea override those of you.

Where processing of Personal Data has been restricted in accordance with the above, such Personal Data shall, with the exception of storage, only be processed with your consent or for the establishment, exercise or defense of legal claims or for the protection of the rights of another natural or legal person.

Right to data portability

You have the right to receive the Personal Data concerning you in question, which you have provided to EU Organic Tea, in a structured, commonly used and machine-readable format and have the right to transmit those data to another data controller without hindrance from EU Organic Tea in the instances as further described in Article 20 of the GDPR.

Where technically feasible, you have the right to have the Personal Data transmitted directly from EU Organic Tea to another controller.

The right to data portability does not apply to the extent that it will adversely affect the rights and freedoms of others.

Right to object

You have a right to object to EU Organic Tea’s processing of Personal Data related to you and your particular situation.
